Mediation

Mediation in Duluth

Divorce mediation

Custody, parenting time, child support, property and spousal maintenance.

Family & community mediation

For disputes between relatives, neighbours or community members.

Workplace & business mediation

For teams, partners and organisations.

Conflict coaching

One-to-one, for when the other party will not come to the table.

It is voluntary, it is confidential, and it is a no-fault process. Nobody is put on trial. The mediator does not decide anything or impose a solution — their job is to keep the conversation productive and help you reach an agreement you can both live with.

Why us

Rule 114 Court Qualified Neutrals. Our mediators are certified and listed on the Minnesota Supreme Court Roster of Neutrals across all areas of Alternative Dispute Resolution.

—  Individual mediators or co-mediation teams. You can request a male/female team, or a team pairing a mental health background with a legal background — useful where the dispute is technically complicated and emotionally loaded at once.

—  Clinical training in the room. Our mediators are also therapists. In a family dispute that is a real advantage: they can tell the difference between a position and the fear underneath it, and they are not thrown by strong emotion.

—  Therapy and mediation under one roof. If a couple in mediation needs support, or a family in therapy needs a decision made, we can move between the two without you starting over with strangers.

The formats

Formal mediation is the structured version: a neutral third party meets with everyone involved and works toward a mutual agreement, without prescribing what that agreement should be. Facilitated conversation is less formal — a supported discussion between two or more people who need to talk something through in a safe, respectful setting, without necessarily producing a written agreement. Which one you need is something we can work out on the phone.

FAQ

Common questions

Is mediation legally binding?

The mediation itself is not. What comes out of it can be — agreements reached in mediation are typically written up and, in a divorce, filed with the court through your attorney. You should each have your own attorney for legal advice and filing.

Is it confidential?

Yes. Mediation is a confidential process, subject to the limits set out in Minnesota law and explained in your mediation agreement.

What if we cannot agree?

Then you have lost less than you would have by litigating first, and you often leave with fewer open issues than you arrived with. Nothing about mediation prevents you going to court afterwards.

Do we have to be in the same room?

Not necessarily. Where being in the same room is not workable, mediators can move between separate rooms. Mediation can also be conducted by video.
